1. Who we are

VibeSafe is an AI-powered code security scanning service operated by SG Digital Ventures LLC, a limited liability company registered in the State of Wyoming, USA (Entity ID: 2026-002034713, Wyoming Secretary of State). Our website is vibesafe.info and our contact email is contact@vibesafe.info.

References to "VibeSafe", "we", "us", or "our" in this Privacy Policy refer to SG Digital Ventures LLC doing business as VibeSafe. For legal correspondence and service of process, please contact us via our registered agent in Wyoming, or email contact@vibesafe.info.

This Privacy Policy explains how we collect, use, and protect your personal information when you use VibeSafe. By using our service, you agree to the collection and use of information in accordance with this policy.

When you paste code into VibeSafe for scanning, that code is processed in memory for the purpose of the scan and is not permanently stored. See Section 5 for full details.

4. How we store and protect your data

Your data is stored on secure servers. We use industry-standard encryption (HTTPS/TLS) for all data in transit. Access to personal data is restricted to essential personnel only.

Our service infrastructure is hosted on Vercel (CDN, hosting, and analytics) and Supabase (database). Both providers maintain high security standards. Payment processing is handled by Stripe, which is PCI DSS Level 1 certified. We use Google Analytics 4 for website analytics; data collected by Google Analytics is processed by Google LLC and subject to Google's Privacy Policy. EU/UK users: Google Analytics data may be transferred to the United States under Google's Standard Contractual Clauses.

While we take every reasonable precaution, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security but commit to notifying you promptly of any breach affecting your personal data.

Your code is private. Code submitted for scanning is processed in memory only, never stored on our servers after the scan completes, never used to train AI models, and never shared with any third party.

9. Children's privacy (COPPA)

VibeSafe is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. For users between 13 and 16, we recommend parental awareness before use.

In compliance with the US Children's Online Privacy Protection Act (COPPA), we do not knowingly collect, use, or disclose personal information from children under 13 without verifiable parental consent. If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us immediately at contact@vibesafe.info and we will delete it promptly.

10. California residents — CCPA/CPRA rights

If you are a California resident, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) grants you the following specific rights:

Do Not Sell or Share My Personal Information: VibeSafe does not sell personal information, and does not share personal information with third parties for cross-context behavioural advertising. We also honour the Global Privacy Control (GPC) opt-out signal where technically feasible.

How to submit a CCPA/CPRA request

Email contact@vibesafe.info with the subject line "CCPA Privacy Request". We will verify your identity and respond within 45 days. We may extend this by a further 45 days where reasonably necessary, with prior notice. You may also designate an authorised agent to submit requests on your behalf — the agent must provide written proof of authorisation.

California's "Shine the Light" law (Civil Code § 1798.83) permits California residents to request a list of third parties to whom we have disclosed personal information for their direct marketing purposes in the preceding calendar year. We do not disclose personal information for third-party direct marketing. To confirm this, email us at the address above.

11. Other US state privacy rights

Residents of the following states have rights under their respective comprehensive privacy laws, which are substantively similar to CCPA/CPRA:

Rights typically include: access, correction, deletion, data portability, opt-out of targeted advertising (we do not conduct targeted advertising), and the right to appeal a denied request. To exercise any of these rights, email contact@vibesafe.info. We will respond within 45 days and provide an appeals process if your request is denied.

Nevada: Nevada residents may opt out of the sale of personal information under Nevada Revised Statutes Chapter 603A. We do not sell personal information. To submit a verified opt-out request regardless, email us at the address above.

If you are located in the United Kingdom, your data is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your rights are equivalent to those described in Section 7. To lodge a complaint, you may contact the Information Commissioner's Office (ICO) at ico.org.uk.

We may update this Privacy Policy from time to time. We will notify you of any significant changes by email or by a prominent notice on our website at least 14 days before the change takes effect. The "Last updated" date at the top of this page will always reflect the current version.

Continued use of VibeSafe after the effective date of changes constitutes acceptance of the updated policy.

1. Acceptance of terms

By accessing or using VibeSafe ("the Service") at vibesafe.info, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 16 years of age.

2. Description of service

VibeSafe is an AI-powered code security scanning service that analyses submitted code for security vulnerabilities, runtime errors, and code quality issues, and provides automated fix suggestions. The Service is provided on a freemium basis with paid subscription tiers.

Important: VibeSafe is a tool to assist with code security. It does not guarantee that scanned code is free from all vulnerabilities. You are responsible for reviewing all suggested fixes before applying them and for the security of your deployed applications.

5. Subscriptions and payments

VibeSafe offers the following paid plans:

Payments are processed securely by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis at the start of each billing period.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months except where required by law.

Price changes: We will give you at least 30 days' notice of any price changes via email before they take effect.

6. Free trial

The Pro plan includes a 15-day free trial for new subscribers. No payment information is required to start the trial. At the end of the trial period, you may choose to subscribe or your account will revert to the free Starter plan. We will not charge you without your explicit action to subscribe.

7. Intellectual property

VibeSafe and its original content, features, and functionality are owned by VibeSafe and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our explicit written consent.

The VibeSafe name, logo, and brand identity are trademarks of VibeSafe. You may not use them without prior written permission.

8. Your content and code

You retain full ownership of all code you submit to VibeSafe for scanning. By submitting code, you grant us a limited, temporary licence to process that code solely for the purpose of providing the scanning service.

We do not claim any ownership over your code. We do not use your code to train AI models. Your code is not stored after scanning is complete. See our Privacy Policy for full details.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. VIBESAFE DOES NOT WARRANT THAT:

VibeSafe is a tool to assist with code security review. It does not replace professional security auditing. You should always review suggested fixes before applying them.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIBESAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold VibeSafe harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate the relationship at any time:

Upon termination, your right to use the Service ceases. We will delete your account data within 30 days of termination, except where retention is required by law.

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions. VibeSafe is operated by SG Digital Ventures LLC, a Wyoming limited liability company (Entity ID: 2026-002034713).

Any disputes not subject to the arbitration clause in Section 14 shall be subject to the exclusive jurisdiction of the state or federal courts located in Wyoming, USA.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws in your jurisdiction that cannot be contractually waived.

For EU/UK users: If you are a consumer resident in the EEA or UK, you may also have the right to bring proceedings in the courts of your country of residence under applicable mandatory law.

14. Dispute resolution (US users)

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and your right to a jury trial.

Informal resolution first

Before initiating any formal dispute, US users agree to contact us at contact@vibesafe.info and give us 30 days to resolve the issue informally. Most concerns can be resolved this way.

Binding arbitration

If we cannot resolve a dispute informally within 30 days, any claim or dispute arising from or relating to these Terms or the Service (excluding small claims and intellectual property matters) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or by JAMS under its Streamlined Arbitration Rules. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Small claims exception

Either party may bring an individual claim in small claims court in their county of residence, provided the claim qualifies under that court's jurisdictional limits.

Class action waiver

YOU AND VIBESAFE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of class or representative proceeding.

Opt-out right

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing contact@vibesafe.info with the subject line "Arbitration Opt-Out" and your name and account email. Opting out does not affect any other part of these Terms.

CAN-SPAM compliance

All commercial emails we send comply with the CAN-SPAM Act. Every email includes a clear unsubscribe mechanism. To stop receiving marketing emails, use the unsubscribe link in any email or contact us at contact@vibesafe.info. We will process opt-out requests within 10 business days.

15. Changes to terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email at least 14 days before the new Terms take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
